These General Terms & Conditions (“Terms”) govern access to and use of pachamamastravel.com (the “Website”) and the booking and participation in experiences offered by Agencia Pachamamas Travel S.A.C. (“Pachamamas Travel”, “we”, “our”, “us”).

By accessing the Website, submitting an inquiry, registering, booking, purchasing, or participating in any of our services (online rituals, self-guided experiences, or in-person journeys/retreats), you become a “User” and agree to be bound by these Terms in full and without reservation. If you do not agree, you must refrain from using the Website and/or our services.

We may also provide Specific Terms (“Specific Conditions”) for particular programs, destinations, ceremonies, pricing, cancellation rules, or partner requirements. Where Specific Conditions apply, they supplement and/or override these Terms for that particular service.

1) Purpose and Nature of Our Services
 

Pachamamas Travel offers transformational travel and consciousness-based experiences that may include:

  • In-person journeys/retreats in sacred territories,

  • Self-guided and in-territory experiences supported by our network,

  • Online access to rituals or community-based practices.

Our Website provides information, inspiration, and booking/request pathways for these services. 

2) Access to the Website
 

Access to the Website is generally free. However, booking and participating in our experiences is subject to payment and to the conditions stated in the specific program details and/or booking confirmation.

We may change, suspend, or discontinue any part of the Website at any time.

3) User Registration and Account Security (if applicable)
 

Some services may require registration or submission of forms. If you create an account or receive login credentials:

  • You are responsible for maintaining the confidentiality of your login details.

  • You agree not to share, sell, transfer, or allow third-party access to your account.

  • You must notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms or contain offensive, misleading, or inappropriate identifiers.

4) Accuracy of Information Provided by Users
 

You agree that all information you provide to us (including identity, travel details, emergency contacts, and any relevant health/dietary information) is true, accurate, complete, and kept up to date.

You are solely responsible for any damage, costs, or disruption caused by false, inaccurate, or incomplete information.

5) Eligibility and Minors
 

Our services are intended for adults. Users must be 18 years or older to book, unless a Specific Condition expressly allows participation by minors under a parent/legal guardian’s responsibility.

Where minors are permitted, the parent/legal guardian is fully responsible for the minor’s actions, safety, and compliance with instructions.

6) Bookings, Payments, and Pricing
 

6.1 Booking confirmation
A booking is confirmed when we receive payment as stated in the program details and you receive a written confirmation (email/WhatsApp or other documented confirmation).

6.2 Pricing
Prices are displayed in the currency indicated in the offer. Prices may include or exclude taxes and local charges depending on the program details. If a payment provider or bank applies exchange rates or additional fees, those are the User’s responsibility.

6.3 Deposits and payment schedules
Some programs may require deposits and later installments. Failure to pay by deadlines may result in cancellation under the program’s Specific Conditions.

7) Cancellations, Changes, and Refunds
 

Cancellation, change, and refund policies depend on the Specific Conditions of each program and will be communicated in the booking confirmation.

We reserve the right to modify itineraries, facilitators, or logistics due to safety, weather, force majeure, availability, or operational needs. Where possible, we will offer reasonable alternatives, rescheduling, or credit, depending on circumstances and the applicable Specific Conditions.

8) Participant Conduct, Respect, and Safety
 

Our experiences may take place in sacred territories and include cultural, spiritual, and nature-based practices. By participating, you agree to:

  • Respect local communities, guides, facilitators, allied spaces, and sacred sites;

  • Follow reasonable instructions from our team and local operators;

  • Refrain from disruptive, unsafe, abusive, discriminatory, or harassing behavior.

We may refuse participation, remove a participant from an experience, or end services without refund where a participant’s behavior:

  • endangers themselves or others,

  • violates laws or local rules,

  • disrespects sacred spaces or community agreements,

  • seriously disrupts the program.

9) Health, Personal Responsibility, and Assumption of Risk
 

Our journeys may involve physical activity, altitude, remote locations, emotional processes, ceremonial contexts, and variable conditions.

By booking and participating, you acknowledge that:

  • You are responsible for assessing your own physical and mental readiness;

  • You will seek medical advice where appropriate;

  • You will disclose relevant allergies, dietary needs, or health limitations that could affect safety or service delivery.

Participation involves inherent risks. You agree that Pachamamas Travel is not responsible for injuries, illness, loss, delays, or damages arising from inherent travel risks or third-party actions, except where caused by our proven negligence as determined by applicable law.

10) Third-Party Providers and Partner Services
 

Some services may be delivered by third parties such as:

  • local guides and facilitators,

  • hotels and allied spaces,

  • transport operators,

  • payment processors and booking tools.

Where services are provided by third parties, their rules and conditions may apply. We are not responsible for third-party acts, omissions, service failures, or content outside our direct control, although we will act in good faith to support resolution where feasible.

11) Prohibited Uses of the Website
 

You agree not to use the Website to:

  • violate laws or third-party rights,

  • upload or transmit malware,

  • attempt unauthorized access, scraping, or interference,

  • publish illegal, abusive, hateful, sexually explicit, or exploitative content (especially involving minors),

  • misrepresent identity or impersonate others,

  • commercialize or advertise unauthorized products/services through our platforms.

We may restrict or terminate access for violations.

12) Intellectual Property
 

All trademarks, brand elements, text, imagery, designs, and content on the Website are owned by Pachamamas Travel or used under permission, unless otherwise stated.

You may view and use the Website content for personal, non-commercial purposes only. Any reproduction, modification, redistribution, or commercial use requires prior written authorization.

13) Disclaimer of Warranties
 

To the fullest extent permitted by law:

  • The Website and content are provided “as is” and “as available”.

  • We do not guarantee uninterrupted availability or error-free operation.

  • We do not guarantee that information is always complete or up to date, although we strive for accuracy.

14) Limitation of Liability
 

To the maximum extent permitted by law, Pachamamas Travel shall not be liable for:

  • indirect, incidental, special, consequential damages,

  • loss of profits, loss of opportunities, or reputational damages,

  • losses arising from third-party providers or force majeure events (see Section 15).

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15) Force Majeure
 

We are not liable for failure or delay in performance due to events beyond our reasonable control, including (without limitation): natural disasters, extreme weather, strikes, civil unrest, war, terrorism, governmental actions, pandemics, transport disruptions, or shortages of services.

16) Modifications to the Website or These Terms
 

We may update these Terms at any time. Updated versions will be posted on pachamamastravel.com with a revised “Last updated” date. Continued use of the Website or services after changes constitutes acceptance of the updated Terms.

17) Term and Termination
 

These Terms remain in effect while you use the Website and/or participate in our services. We may suspend or terminate access to the Website or services if you breach these Terms or if required for safety, legal, or operational reasons.

18) Severability
 

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

19) Governing Law and Jurisdiction
 

These Terms are governed by the laws of Peru. Any dispute shall be submitted to the competent courts of Lima, Peru, unless mandatory consumer protection rules provide otherwise.
